Hidden Woods Real Estate Terms of Use Policy

BY ACCESSING THIS SITE, YOU AGREE TO THE FOLLOWING TERMS AND CONDITIONS OF SITE USE AGREEMENT (AGREEMENT).

Definitions. “Hidden Woods Real Estate" shall mean the entire brokerage office of  Hidden Woods Real Estate, LLC, its employees, officers, directors and all other persons or entities affiliated with Hidden Woods Real Estate responsible for creating, maintaining and publishing this Site. "Content" shall mean all information or images contained on the Site, including but not limited to, trademarks, copyrights, advertisements, data, text, graphics, photographs, software and video. "Site" shall mean the Internet site located at the URL address www.hiddenwoodsrealestate.com. "User" shall mean any person or entity that accesses or uses the Site in any manner.

Acceptance of Terms. By accessing or using any part of the  Hidden Woods Real Estate Site or the services provided on it or other Web sites as set forth below (collectively, the “Services”), you agree to accept and comply with the terms, conditions, and notices stated herein and as may be modified by  Hidden Woods Real Estate from time-to-time without notice to you (the “Terms of Use”). These Terms of Use constitute a binding contract between Hidden Woods Real Estate and you. You are responsible for regularly reviewing the Terms of Use. If you do not wish to be bound by these Terms of Use, please do not access or use any part of the  Hidden Woods Real Estate Site.

Further, please note that certain of the interactive Services may be financial or mortgage tools that provide information and customized information based on user-inputted data. These tools are for the purpose of performing calculations, and are not an offer to lend. Interest rates shown are for demonstration purposes only. Actual market interest rates may vary. You acknowledge that  Hidden Woods Real Estate is not a mortgage broker or mortgage lender, and  Hidden Woods Real Estate does not aid or assist borrowers in obtaining, soliciting borrowers or lenders for, negotiate or make loans secured by liens on real property. Please note that you may be subject to additional and/or different terms, conditions, and privacy policies when you use third party Services, Content (as defined below), software or sites.

Content Contained in the Hidden Woods Real Estate Site. The Content of this Site is copyrighted by  Hidden Woods Real Estate or other persons and entities that provide information to the Site. Users of this Site are granted a limited nonexclusive license to use the Site and its Content for personal use but not for any other use including political or commercial use. Except as permitted in this Agreement, Content may not be reproduced, sold, transferred, modified, redistributed, retransmitted, published or exploited for any purpose without the express written permission of  Hidden Woods Real Estate or appropriate owner of the information.

Users may not use any Content which identifies REALTORS® or other persons, their mailing addresses, telephone numbers or email addresses except for the sole purpose of seeking or generating referrals or initiating relationships for the purpose of obtaining brokerage or related services from the REALTOR® without advance written approval of  Hidden Woods Real Estate.  With regard to personal use, users may print or copy Content from this Site that is copyrighted or owned by Hidden Woods Real Estate provided that such copies are not modified or revised in any manner and include proper notices indicating that the Content is copyrighted or owned by  Hidden Woods Real Estate. (such as "Copyright© [Insert Year]"). In addition, any Content that comes from pages of this Site that contain disclaimers must be printed or copied with the disclaimer included in its entirety. In the event a User wishes to print Content from this Site, or other sites linked to from this Site, that is copyrighted or owned by a person or entity other than  Hidden Woods Real Estate, the User must obtain permission from the appropriate owner to do so. Personal use includes providing copies to others within the member’s firm, to other members, to a member’s attorney, or to attendees at a seminar or other non-profit educational presentations. Unless otherwise indicated,  Hidden Woods Real Estate does not endorse, approve or otherwise warrant the accuracy of any information or content contained on a linked site. The User agrees that the sites, including information, material, products and services therein, shall be used solely at the User’s own risk. Furthermore, because the  Hidden Woods Real Estate privacy policy is applicable only when you are on the  Hidden Woods Real Estate Site, once linked to another website, you should read that site’s privacy policy before disclosing any personal information. Modification of Terms And Conditions Of Site Use Agreement.  Hidden Woods Real Estate reserves the right, in its sole discretion, to modify or revise this Agreement at any time without giving notice. The modifications shall be effective immediately upon posting of the modified Agreement. Accordingly, the User agrees to review the Agreement periodically, and the User’s continued access or use of Site shall be deemed the User’s acceptance of the modified Agreement. 

International Visitors.  Hidden Woods Real Estate Site welcomes visitors to the Site from across the world.  Hidden Woods Real Estate operations are, however, located in the United States and its policies and procedures are based on United States law. If you are located outside of the United States, you consent to the transfer, storage and processing of your information, such as registration information or email addresses, in the United States. Additionally, if you are accessing the Site from a country embargoed by the United States, you agree to not engage in any commercial activities, including financial transactions,  through the Site.

GENERAL TERMS DISCLAIMER REGARDING WARRANTIES. EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, TITLE, NON INFRINGEMENT OF INTELLECTUAL PROPERTY, SECURITY AND FITNESS FOR A PARTICULAR PURPOSE. SUSPENSION OR TERMINATION OF ACCESS. HIDDEN WOODS REAL ESTATE RESERVES THE RIGHT, IN ITS SOLE DISCRETION, TO SUSPEND OR TERMINATE A USER'S ACCESS TO THE SITE FOR ANY REASON, INCLUDING BUT NOT LIMITED TO, A USER'S BREACH OF THIS AGREEMENT. 

INDEMNIFICATION. THE USER AGREES TO DEFEND, INDEMNIFY AND HOLD HARMLESS HIDDEN WOODS REAL ESTATE FROM ANY AND ALL LIABILITIES, LOSSES, CLAIMS, COSTS AND EXPENSES INCLUDING, BUT NOT LIMITED TO, REASONABLE ATTORNEY'S FEES, RELATED TO THE USER'S VIOLATION OF ANY TERM OF THIS AGREEMENT OR ALLEGED ILLEGAL USE OF THIS SITE. 

RESERVATION OF RIGHTS. ALL RIGHTS NOT EXPRESSLY GRANTED OR ADDRESSED HEREIN ARE RESERVED BY HIDDEN WOODS REAL ESTATE.

LIMITATION OF LIABILITY. IN NO EVENT SHALL HIDDEN WOODS REAL ESTATE BE LIABLE FOR ANY DIRECT, INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL DAMAGES OR ANY DAMAGES WHATSOEVER INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF USE, DATA OR PROFITS, ARISING OUT OF OR IN ANY WAY CONNECTED WITH THE USE OR PERFORMANCE OF HIDDEN WOODS REAL ESTATE SITE, WITH THE DELAY OR INABILITY TO ACCESS OR USE THE HIDDEN WOODS REAL ESTATE SITE OR RELATED SERVICES, THE PROVISION OF OR FAILURE TO PROVIDE SERVICES, OR FOR ANY CONTENT, SOFTWARE, PRODUCTS AND SERVICES MADE AVAILABLE OR OBTAINED THROUGH THE HIDDEN WOODS REAL ESTATE SITE, OR OTHERWISE ARISING OUT OF THE USE OF THE HIDDEN WOODS REAL ESTATE SITE, WHETHER BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY OR OTHERWISE, EVEN IF HIDDEN WOODS REAL ESTATE HAS BEEN ADVISED OF THE POSSIBILITY OF DAMAGES. ANY SERVICES OR CONTENT MADE AVAILABLE OR OBTAINED THROUGH THE USE OF THE HIDDEN WOODS REAL ESTATE SITE, AND ALL OTHER USE OF THE HIDDEN WOODS REAL ESTATE SITE, IS DONE AT YOUR OWN DISCRETION AND RISK AND YOU WILL BE SOLELY RESPONSIBLE FOR ANY DAMAGE TO YOUR COMPUTER SYSTEM OR LOSS OF DATA THAT RESULTS THEREFROM.

IF YOU ARE DISSATISFIED WITH ANY PORTION OF THE HIDDEN WOODS REAL ESTATE SITE, OR WITH ANY OF THESE TERMS OF USE, YOUR SOLE AND EXCLUSIVE REMEDY IS TO DISCONTINUE USING THE HIDDEN WOODS REAL ESTATE SITE.

APPLICABLE LAW. THE TERMS OF USE AND THE RESOLUTION OF ANY DISPUTE RELATED TO THIS AGREEMENT OR THE SITE SHALL BE GOVERNED BY AND INTERPRETED ACCORDING TO THE LAWS OF THE STATE OF WISCONSIN (WITHOUT APPLYING ANY APPLICABLE CONFLICT-OF-LAW PRINCIPLES). HIDDEN WOODS REAL ESTATE’S FAILURE TO INSIST UPON STRICT ENFORCEMENT OF ANY PROVISION OF THIS AGREEMENT SHALL NOT BE CONSTRUED AS A WAIVER OF ANY PROVISION OR RIGHT. IN THE EVENT A DISPUTE ARISES BETWEEN THE USER AND HIDDEN WOODS REAL ESTATE FROM THIS AGREEMENT OR USE OF THE SITE, SUCH DISPUTE SHALL BE BROUGHT EXCLUSIVELY IN A FEDERAL OR STATE COURT OF COMPETENT JURISDICTION SITTING IN THE NORTHERN DISTRICT OF WISCONSIN FEDERAL COURT OR SAWYER COUNTY, WISCONSIN STATE COURT. 

USER'S CONSENT TO BE LEGALLY BOUND TO AGREEMENT. IN CONSIDERATION OF BEING ALLOWED TO USE THE SITE, YOU AGREE TO BE BOUND BY THE TERMS AND CONDITIONS OF THIS AGREEMENT. USE OF THE SITE IN ANY MANNER SHALL CONSTITUTE YOUR ACCEPTANCE OF THIS AGREEMENT AND YOUR ASSENT TO BE LEGALLY BOUND BY THIS AGREEMENT. IF YOU DO NOT AGREE TO BE LEGALLY BOUND BY ALL THE TERMS AND CONDITIONS OF THIS AGREEMENT, YOU ARE STRICTLY PROHIBITED FROM ACCESSING AND/OR USING THIS SITE IN ANY MANNER.

SEVERABILITY. IF ANY PROVISION OF THIS AGREEMENT IS DETERMINED TO BE UNLAWFUL, VOID OR UNENFORCEABLE, IT WILL NOT AFFECT THE VALIDITY AND ENFORCEABILITY OF ANY REMAINING PROVISIONS.

Introduction. Hidden Woods Real Estate operates the web site at www.hiddenwoodsrealestate.com ("Site"). We respect the privacy of each user of the Site (referred to as "you" or "a user"), whether you are just beginning your real estate search or have previously visited our Site. This Privacy Statement gives you specific information about how we protect your privacy, how we treat information we collect on the Site that identifies an individual user ("Personal Information"), and how we use aggregated information.  BY REGISTERING FOR OR USING THE SITE, YOU SIGNIFY YOUR ACCEPTANCE OF THIS PRIVACY STATEMENT. IF YOU DO NOT AGREE TO THIS PRIVACY STATEMENT, YOU CANNOT USE THE SITE. We reserve the right to modify this Statement at any time by posting a notice on the Site's home page. (If we consider it appropriate, we may also provide additional notice of significant changes.) Your use of the Site after the date of the last modification listed at the beginning of this Privacy Statement indicates to us that you agree to the changes.

Location of Servers and Transfer of Information to the United States. The Site is hosted by servers in the United States. If you are located outside of the United States, your Personal Information will be transferred to the United States. Accordingly, this Statement does not apply to a sales associate's website or to a sales associate's collection, use, storage and disclosure of your Personal Information.

Collection and Use of Your Personal Information. We collect your Personal Information on the Site in order to enhance the services we offer you. We collect Personal Information from you only when you voluntarily submit it in order to obtain certain services or information, including (A) registrations for special communications, such as saving a search for you and, but only if you request it, sending you new listings that fit the profile of your saved search; (B) requests to find a property, to list your property, and to find a sales associate; (C) requests to contact us; (D) requests to receive periodic industry updates; (E) requests to email a listing to a friend.

Requests to Find or List a Property and to Find a Sales Associate. If you submit a request through this Site to find or list a property or to find a sales associate, you will be asked to provide Personal Information and we refer this information to sales associates to respond to your request. 

Contacting Us. If you contact us, we collect Personal Information, which is retained or referred to a sales associate depending on the nature of your inquiry. If you are looking for a property or a sales associate, it is referred to a sales associate; if your inquiry or complaint requires a response from us, it is referred to the appropriate department for research and a response. The information we collect is not used in any other way.

Collection of Non-Personal Information. Even if you do not send us any Personal Information, we collect information about how you use our site ("Non-Personal Information"). This information cannot be used to identify you personally and is explained in more detail below under "Non-Personal Information".

Cookies. A cookie is a small data file, often including an anonymous unique identifier, that is sent from a web site's computer and stored on your computer's hard drive. Use of cookies is common on the Internet. We may also use the Personal Information to inform you about other services and products that may be available through us, companies with which we have a marketing relationship, and to provide you a customer survey to assess your satisfaction with our services and products. We may allow others to provide audient measurement and analytics services for us. These entities may use cookies, web beacons, SDKs, and other technologies to identify your device when you use the Site, as well as when you visit other online sites and services, and such services will be covered by the privacy policy of the respective third parties. Sharing Your Information. We reserve the right to share your Personal Information with our marketing partners, as permitted by law, in order to fulfill our commitment of providing you with full service real estate brokerage services. We do share your Personal Information under the following circumstances:

A. Third party vendors we engage to provide services on our behalf, such as hosting, web-site development, and support, have access to Personal Information, but they have agreed not to disclose the Personal Information or to use it for any purpose other than providing the requested services.

B. There may arise special circumstances where it is necessary for us to disclose and use Personal Information and Non-Personal Information, such as: to enforce this Privacy Statement or any other part of our Terms & Conditions to protect our property or rights; to protect the safety of anyone; to investigate, prevent, or take action regarding illegal or improper activities; to carry out a merger or consolidation with another entity, a sale or transfer of some or all of our assets, or any similar transaction; or for other reasons we determine in good faith are necessary, appropriate, or required by law, such as when we respond to subpoenas, court orders, or other legal or administrative process.
